Terms of Service

These Terms of Service ("Terms") govern your use of FluentSub, the realtime transcription and translation service available at fluentsub.com (the "Service"), operated by FluentSub ("we", "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

You must provide accurate information when registering and keep your credentials confidential. You are responsible for all activity that occurs under your account. Notify us promptly at support@fluentsub.com if you suspect unauthorized use of your account. You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service.

An individual account is licensed to one natural person. You may not share credentials or let multiple people use one account. Each collaborator must use their own account through the Service's team features. An account may have up to three active devices and one realtime session at a time.

You agree not to:

• use the Service for any unlawful purpose or in violation of any applicable law or regulation;
• record, transcribe, or translate audio without the consent required by applicable law;
• infringe the intellectual-property or privacy rights of others;
• attempt to probe, disrupt, reverse engineer, or gain unauthorized access to the Service or its infrastructure;
• resell or redistribute the Service, or circumvent usage metering, trial limits, or billing;
• use automated means to create accounts or to abuse free trial minutes or referral credits.

We may suspend or terminate accounts that violate these rules.

You are solely responsible for complying with all laws, regulations, and institutional policies that apply to capturing, transcribing, or translating audio in your location — including obtaining any consent required from the people being recorded and following your school's or employer's recording policies. Consent requirements vary by jurisdiction and institution; the Service does not determine whether your use is lawful, and nothing in the Service or these Terms constitutes legal advice. In-product reminders about consent are provided as a courtesy and do not replace your own obligations.

You retain all rights to the audio you capture and the transcripts and translations produced from it ("Your Content"). You grant us a limited license to process Your Content solely to provide the Service, including transmission to service providers in the processing categories described in our Privacy Policy. We do not use Your Content to train our own models and we do not sell it.

Paid plans are offered as monthly subscriptions and one-time prepaid minute packs, billed through our payment processor. Prices and included minutes are shown on the pricing page at the time of purchase. Cancellations and refunds are governed by our Refund Policy. Trial minutes are free, one-time, and expire as stated at signup.

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. Automated transcription and translation are inherently imperfect; the Service's output may contain errors and must not be relied on as the sole basis for medical, legal, financial, or other consequential decisions. We do not guarantee uninterrupted or error-free operation.

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Our total aggregate liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD 50. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access for breach of these Terms, suspected fraud or abuse, or where required by law. Upon termination, your right to use the Service ends; sections that by their nature should survive (including Sections 7, 8, and 10) survive termination. You may request deletion of your data as described in the Privacy Policy.

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. Any dispute shall be brought in the state or federal courts located in Texas, unless applicable consumer-protection law provides otherwise.

We may update these Terms from time to time; material changes will be announced on the site, and the "Last updated" date above will change. Continued use after changes take effect constitutes acceptance. Questions about these Terms: support@fluentsub.com.
